Terms and Conditions of Sales

 Mars Window and Door System Inc. (hereinafter, “Mars Window”) hereby adopts the following terms and conditions which shall apply to all contracts for sales and orders of Mars Window product/s.  

The Buyer is to carefully review the order acknowledgement in its entirety, verifying the product specifications as stated. Mars Window will manufacture product/s in accordance with the order acknowledgment and will not be responsible for any issues regarding the product dimension, color, quantity, and/or options given the Buyer’s approval of the order acknowledgment.

Mars Window will manufacture product/s pursuant to the product specifications as stated on the order acknowledgment, approved by the Buyer. Mars Window will not be responsible for any issues that may arise with the Homeowners Association (HOA) for any design reasons. The Buyer is to verify that all product/s are in compliance with the Homeowners Association’s (HOA) regulations prior to approval of the order acknowledgment. 

The Buyer shall pay a hundred percent (100%) of the product/s’ price, due at the time of sale. Mars Window will not start production unless the order has been paid in full. Alternate terms of payment may only be in effect if approved by Mars Window prior to the sale. All overdue or delinquent payments will accrue interest at the rate of one and one-half percent (1 ½%) per month or the maximum legal interest rate. Mars Window is required to charge and remit sales tax in accordance with States’ laws, based on the delivery address of the order. Tax exemption will only apply if the Buyer provides Mars Window with a tax exemption certificate. 

The Buyer can make modifications to the product dimension, color, quantity and/or options on the order or cancel the order up to 24 hours after the approval of the order acknowledgment. Any requests for modification to the product dimension, color, quantity, and/or options on the order or order cancellation after 24 hours following the approval of the order acknowledgment will not be allowed. Orders cannot be canceled if a cancellation request was not submitted within the 24 hours range as stated. Products cannot be returned by the Buyer without Mars Window’s prior consent and authorization. Mars Window reserves the right to refuse and reject return requests. 

Delivery of the order occurs upon either the Buyer’s pick up of the product/s at Mars Window’s factory or the Buyer’s receipt of the product/s at an address as designated by the Buyer. If a delivery address was not designated by the Buyer at the time of sale, delivery will be made at Mars Window’s factory. Mars Window will employ reasonable means to ensure the delivery is made at the time and to the address as designated by the Buyer. However, Mars Window will not be responsible for any losses, damages, and/or delays due to circumstances outside of Mars Window’s control such as, but not limited to, fire, flood, embargo, transportation delays, federal, state and/or municipal laws or regulations etc. that prohibits Mars Window from conducting its normal course of business.
